PREVAILING TRICYCLE FARE RATE IN THE MUNICIPALITY OF TAYTAY, PALAWAN

AN ORDINANCE GRANTING A SPECIAL FARE MATRIX FOR TRICYCLES IN THE MUNICIPALITY OF TAYTAY, PALAWAN UNTIL SOCIAL DISTANCING MEASURES PRESCRIBED BY THE NATIONAL GOVERNMENT HAS BEEN LIFTED.
WHEREAS, on March 16, 2020, President Rodrigo Roa Duterte placed the entirety of Luzon under Enhanced Community Quaratine until April 30, 2020 which extended up to May 15, 2020.
WHEREAS, The province of Palawan including the Municipality of Taytay, Palawan was was placed under General Community Quarantine (GCQ) starting May 1, 2020 to May 15, 2020;
WHEREAS, on April 26, 2020, the Department of Transportation (DOTr) issued a protocol that tricycles are only allowed to accommodate one passenger per trip with the strict compliance to physical distancing between the driver and the passenger;
WHEREAS, Sections 458 (a) (3) (vi) of Republic Act no. 7160, otherwise known as the Local Government Code of 1991, essentially provide that the Sangguniang Bayan has the power to regulate the operation of tricycles within the territorial jurisdiction of the Municipality subject to guidelines prescribed by the Department of Transportation and Communications (DOTC).
WHEREAS, with the increase of minimum fare, it shall be a deterrence to the public to pursue unnecessary actions outside the safety of their homes;
WHEREAS, there is a compelling reason to adjust the rate of tricycle fares within the Municipality during the prescribed distancing of DOTr, considering they are only allowed to accommodate one passenger per trip, to ensure that the drivers and operator will be given chance to earn a living without compromising the safety and welfare of the commuters in this trying times;
NOW THEREFORE, on motion of Hon. Mary Quelamae G. Catedral, duly seconded by Hon. Cherie Anne A. Rodriguez
Be it ordained by the Sangguniang Bayan in Regular Session assembled that,
SECTION 1. TITLE. This ordinance shall be known as “TRICYCLE SPECIAL FARE MATRIX DUE TO COVID-19.
SECTION 2. COVERAGE. This ordinance shall cover all authorized tricycle for hire within the territorial jurisdiction in the Municipality of Taytay.
SECTION 3. RATE OF FARES. The following shall be the special rate of fares for tricycle for hire in the Municipality of Taytay until the prescribed distancing of DOTr has been lifted.

SECTION 4. DISCOUNTED FARE. Discounted fare on Senior Citizens, disabled persons, and students shall be directly observed in accordance with the existing laws.
SECTION 5. SOCIAL DISTANCING POLICY IN TRICYCLE. As prescribed by the Department of Transportation (DOTr), tricycles are allowed to accommodate only ONE PASSENGER in the side-car for every trip within the Municipality of Taytay. No passenger shall be seated right beside or behind the driver.
SECTION 6. IMPOSITION OF PENALTY. Penalty for violation of this ordinance shall be referred to Section 3 of Ordinance No. 372-2020 of the Municipality of Taytay, Palawan.
SECTION 7. SEPARABILITY CLAUSE. If for any reasons any sections or provision of this ordinance is declared unconstitutional or invalid, the other sections or provision thereof which is not affected shall continue in full force and effect.
SECTION 8. AUTOMATIC EXPIRATION CLAUSE. The effectivity of this ordinance shall cease upon the lifting of Corona Virus pandemic and the Social Distancing policy for PUVs.
SECTION 9. EFFECTIVITY CLAUSE. This ordinance shall take effect immediately upon its approval.

AN ORDINANCE ESTABLISHING THE CONSERVATION AND SUSTAINABLE TOURISM FEE SYSTEM, OTHER TOURISM FEES, REVENUE SHARING SYSTEM, CREATION OF CONSERVATION AND SUSTAINABLE TOURISM TRUST FUND AND ITS MANAGEMENT BOARD, IMPLEMENTATION OF THE TAYTAY TOURIST PASSPORT (PASAPORTE) AND ONLINE CSTF PAYMENT PLATFORM, TOURISM RULES, REGULATIONS, PROHIBITIONS AND RESTRICTIONS, AND IMPOSING PENALTIES FOR VIOLATION THEREOF IN THE MUNICIPALITY OF TAYTAY, PALAWAN
Section 7. LGU Regulated Tariffs on Tour Guide and Transport and Community and Barangay Revenue Sharing Scheme. The following tariffs for tourism related service fees and charges, including the revenue sharing system for Community Based Sustainable Tourism Organizations is hereby adopted in this ordinance to promote accountability, transparency, and to foster the sharing economy for the tourism industry in Taytay.

- Porter – Php800.00/day/≤/12kg load
- Snorkeling Guides – Php500.00//≤5guests/4 hrs
- Biking guides – Php800.00//≤6guests/trip
- Note: In excess of the allowed number of guests per guide, an additional guide must be hired.

A.1 Boat Rental Tariff for Malampaya Sound Protected Landscape and Seascape Routes.
Note:
- Cost for one way trip is 80% of the above roundtrip tariff rates.
- Above rates were computed as of February 15, 2022 fuel price (Diesel: Php64.60, Regular Gasoline: Php76.76, and Unleaded Gasoline Php77.76) Should there be an increase in fuel cost of at least Php10.00 per liter, the legislated rental rate will be increased by supplementing it with an add-on rate that will be computed using the following formula:

Notes:
1. Costing was based on initial daily round trip (RT) rate of Php 2,500.00 for the first 0-24KM and a subsequent increment of PhpPhp29.7619 per additional kilometer in excess of the first 24KM. This rate was based on a round trip van hire for Liminangcong @Php5,000.00.
2. Daily Rate means that the van was hired round trip for a maximum of eight hours. Beyond such time, an hourly rate of Php 300.00 will apply on top of the daily rate. Overnight rate will be charged with 50% of the daily rate.
3. For easier accounting, rates with fractions of less than Php100.00 were rounded off to the nearest hundred e.g. for Pulariquen, the computed rate is Php2,976.19, this was rounded off to Php3,000.00 while for Silanga, the computed rate is Php4,404.76, hence rounded to Php4,400.00.
4. Passengers coming from Apulit Island Resort and Other Resorts from Taytay Bay and Malampaya Sound must utilize local tourist vans registered in Taytay, Palawan for ferrying their guests outbound of Taytay. Only in cases where there are no available local vans will non-Taytay registered vans be allowed to pick up outbound guests. For inbound guests, they may choose which ever transport they prefer depending on the origin of their guests.

Sample Computation for Poblacion to Abongan (Ibangley) with a Php3,500.00 RT Rate and a fuel increase of Php10.00.
Fuel Cost Increase Adjusted Rate will then be equal to Legislated Rate + Add on rate (AOR)
= Php3,500.00 + Php350.00
= Php3,850.00
